(I) ACCEPTANCE OF TERMS
Tradesindex.com is a collection of online resources, which includes user job postings and profile pages for various trades, collectively herein referred to as ("Tradesindex Services"). It is also compromised of several email services subject to the following Terms of Use ("TOU"). By using tradesindex.com in any way, as a “User” (Either as a Visitor -which means you simply browse the TradesIndex website- or as a Member -which means you have registered with tradesindex.com-), you are agreeing to comply with the TOU and any applicable laws. In addition, when using certain Tradesindex Services, you agree to comply with any tradesindex.com guidelines that may be imposed. These guidelines are dynamic and they may be altered from time to time. Should the user object to any term or condition, or any future amendments to the TOU, or in any way become dissatisfied with the Tradesindex Services; they are to discontinue use of tradesindex.com immediately. If you wish to become a Member of TradesIndex Services you must read this TOU and indicate your acceptance during the Registration process.
(II) MODIFICATIONS TO THIS AGREEMENT
Tradesindex.com reserves the right, at their sole discretion to change, alter, or modify these terms and conditions at any time. Modifications will become effective immediately upon the posting thereof. The User should review the TOU on a regular basis to keep themselves current of any changes. (III) CONTENT
The user understands and agrees that all postings, messages, files, images, photos, videos, text, sounds, or other materials ("Content") posted on, transmitted through, or linked from Tradesindex Services, are the sole responsibility of the person from whom such Content originated. More specifically, the user is responsible for each individual item ("Item") of Content that they post, email or make available via the Tradesindex Services. The user must understand that tradesindex.com in no way controls, or is responsible for Content made available through Tradesindex Services. Therefore by using the Tradesindex Services, the user may be exposed to Content that is inaccurate, misleading, offensive or otherwise objectionable. The tradesindex.com site and User posted Content may contain links to other websites which are completely independent of tradesindex.com, and linking to those sites is at the User’s own risk. The User agrees that they must determine on their own, and bear all risks associated with the use of any Content, and that they may not rely on said Content, in any way shape or form. The User agrees that under no circumstances will tradesindex.com be liable in any way, or for any loss or damage of any kind incurred as a result of the use of any Content made available through the Tradesindex Services. Tradesindex.com shall have the right, but not the obligation, to delete or move any Content available through the Tradesindex Service.
(IV) THIRD PARTY CONTENT, SITES, AND SERVICES
Tradesindex.com and Content found on the Tradesindex Services may contain links or advertisements that provide access to third party content which is completely independent of tradesindex.com. The User’s interactions with organizations and/or individuals found through the Tradesindex Services, including payments and delivery of goods and services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the User and such organizations and/or individuals. The User should research and use their judgement, not rely on Content found on tradesindex.com, before proceeding with any sort of transaction with any of these third parties.
Furthermore, the User agrees that tradesindex.com shall not be liable or held responsible for any loss or damage of any sort incurred as a result of any such dealings. If a dispute arises between participants on this site, or between a user and any third party, the User understands that tradesindex.com is under no obligation to become involved. In the event that a dispute arises between Users, Visitors, Members, or any third party, the parties involved hereby release tradesindex.com, its officers, employees, agents and successors in rights from claims, demands, and damages (actual and consequential) of any kind or nature, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes and / or the Tradesindex Services.
(V) COPYRIGHT POLICY
If you believe that your work has been copied in a way that constitutes copyright infringement, send all details consisting of:
1) A description of the copyrighted work that you claim has been infringed
2) A description of where the material you claim is infringing is located on the tradesindex.com site
3) Your address, telephone number and email.
4) A written statement that to the best of your knowledge, the use is not authorized by the copyright owner, its agent, or the law
5) A statement and an electronic signature stating that the above information is accurate and you are the copyright owner or authorized to act on the copyright owners behalf.

(VI) Privacy Policy

The User must agree to the terms in the Privacy Policy prior to any use of the Tradesindex Services.
(VII) USER CONDUCT
The User agrees not to post, email, or make available Content:
1) That is unlawful or illegal;
2) Threatening, harmful or abusive;
3) That harasses, degrades, or is hateful toward an individual or organization;
4) That impersonates any person or organization;
5) That includes identifiable information about a person or organization without their explicit consent;
6) That is false, deceptive or misleading, deceitful ;
7) That infringes any patent, trademark, copyright, or other proprietary rights of any party, or Content that you do not have a right to make available;
8) That constitutes or contains “spam,” “pyramid schemes,” “junk mail,” or unsolicited commercial advertisement;
9) That attempts to solicit tradesindex.com Members and Users regarding commercial interests not related to the site ;
10) That disrupts the flow of content (flood attack) or attempts to destroy or limit the functionality of any computer hardware or software (viruses, malware and/or harmful code);
11) That manipulates identifiers or forges headers to disguise the origin of the Content transmitted through the Tradesindex Services;
The User agrees not to,
1) Contact anyone who has asked not to be contacted;
2) Collect personal data about Users for commercial or illegal purposes
3) Use automated means of any kind to download data from Tradesindex.com services, unless expressly permitted by tradesindex.
4) Post or upload irrelevant Content, or repeatedly post the same or similar Content
5) Attempt to gain unauthorized access to tradesindex.com’s computer systems or engage in any activity that disrupts or diminishes the quality of any Tradesindex Services
6) Use any automated program or device that enables postings or profiles to be created without manual entry by the author thereof
7) Use Posting Agents and/or third party services that offer to post Content to Tradesindex Services on behalf of others. In addition, Posting Agents are prohibited to post content on behalf of others, unless express permission is given by tradesindex.com
(VIII) NO SPAM POLICY
The User agrees and understands that sending unsolicited email advertisements to tradesindex.com email addresses or though the tradesindex.com computer systems, is prohibited by the terms set forth in this TOU, and will result in prosecution to the full extent of the law and indefinite banning from the Tradesindex Services.
(IX) LIMITATIONS OF SERVICE
The User acknowledges that tradesindex.com may at any point impose certain limitations concerning the use of Tradesindex Services, including limiting the maximum number of days content will be retained, limiting the maximum size and length of the postings, email messages, or any other Content that could be transmitted or stored by the Tradesindex Services. The user agrees that tradesindex.com is not responsible or liable for any loss of Content or for failure to maintain Content transmitted or stored on its systems. Tradesindex.com may at any time modify or discontinue the Tradesindex Services (or any part thereof) with or without notice.
(X) ACCESS TO THE SERVICE
Tradesindex.com grants you a limited, nonexclusive, revocable licence to access the Tradesindex Services for your own personal and non-commercial use. This license excludes posting agents, and/or robots, spiders or any manual collection of Users personal information for commercial or personal use unless explicitly authorized by tradesindex.com. Tradesindex.com permits you to display a hyperlink on a personal or media website so long as it is a hyperlink to your own Content and does not portray tradesindex.com in a false, misleading, derogatory or offensive manner. If you publish the links of multiple trades or Content that you did not author, you will be in violation of this agreement.
Use of Tradesindex Services other than those outlined above will result in violation of the TOU and the Users license revoked.
(XI) TERMINATION OF SERVICE
The User agrees that tradesindex.com has the right to remove or delete any Content it deems inappropriate or in violation of this TOU. Tradesindex.com has the right to cancel and ban any Users account, e-mail and IP address that is in violation of this TOU, with or without notice and for any reason. Furthermore, the User agrees that tradesindex.com will not be held liable or accountable for the termination of access to the Tradesindex Services.
(XII) DISCLAIMER, INDEMINITY AND LIMITATION OF LIABILITY
TRADESINDEX.COM SHALL UNDER NO CIRCUMSTANCES BE HELD LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR EXEMPLARY DAMAGES RESULTING FROM ANY ASPECT OR USE OF THE TRADESINDEX.COM SERVICE OR SYSTEM. THIS ALSO INCLUDES DAMAGES FROM MISUSE, NOT BEING ABLE TO ACCESS THE SITE, POOR PERFORMANCE, ALTERATION OR TOTAL TERMINATION OF THE SITE AND SERVICES. THIS LIMITATION ALSO IMPLIES TO DAMAGES OR OTHER LOSSES OCCURING FROM INFORMATION OR PRODUCTS RECIEVED FROM CONTENT OR ADVERTISING PRESENT ON THE TRADESINDEX.COM SITE. FURTHERMORE, USERS AGREE TO INDEMNIFY TRADESINDEX.COM AND ALL OF ITS ASSOCIATES, DIRECTORS, INVESTORS OR EMPLOYEES HARMLESS FROM ANY CLAIMS OR DEMANDS AND/OR COURT/ATTORNEY FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF CONTENT YOU SUBMIT, POST OR MAKE AVAILABLE THROUGH THE SERVICE, OR YOUR VIOLATION OF THE RIGHTS OF ANOTHER.

GENERAL INFORMATION
Tradesindex.com is a registered trademark and any reproduction or use of the Tradesindex Services or trademark will result in prosecution to the full extent of the law of where Tradesindex.com corporate headquarters reside, Vancouver Canada. Furthermore, you agree that any court proceedings or actions against tradesindex.com will take place in the courts of Vancouver, Canada. Furthermore, by posting Content or using Tradesindex Services to transfer content, you grant tradesindex.com a non-revocable, perpetual, worldwide, non-exclusive, debt-free license for Tradesindex to copy, use, display, and distribute all said Content as they see fit.
